Terms of Service

1. Who We Are

The Athlete World platform ("Service") is operated by Athlete World GmbH, a company registered in Switzerland, Hohlstrasse 207, 8004 Zürich, Switzerland, UID: CHE-369.002.950 ("we", "us"). These Terms of Service ("Terms") are a contract between you and us.

2. Acceptance of These Terms

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 16 years old to use the Service.

If you are 16 or 17, you confirm that a parent or legal guardian knows about your use of the Service and consents to it. By using the Service, you confirm that you meet these requirements.

4. Free Service

The Service is free of charge during early access. We may introduce paid features in the future. If we do, we will tell you in advance and explain what costs money and what stays free. We will never charge you silently.

5. Your Account

When you create an account, you agree to:

• Provide accurate and complete information
• Keep your password and account credentials safe
• Tell us right away if someone accesses your account without permission
• Take responsibility for activity that happens under your account

You can delete your account yourself at any time using the "Delete account" option in your profile (or by contacting us, if you cannot sign in). Deleting your account removes your personal data from the Service.

6. Your Content

You keep ownership of the content you submit to the Service, including profile information, athletic stats, and game film. By submitting content, you grant us a non-exclusive, worldwide license to host, display, and distribute it in connection with the Service. The license also covers the technical processing we need in order to run the Service: creating thumbnails and preview images, converting files into other formats and resolutions, and making copies for storage and backup. This license ends when you delete the content or your account, except for residual copies in backups.

You are responsible for your content. This means you must make sure it is accurate and does not violate anyone else's rights. This matters especially for uploaded game film: make sure you are allowed to upload and share it.

When you submit content, you warrant that:

• You own the content, or you hold all rights and permissions needed to upload it and to let us use it as described above
• For game film, you hold the rights needed from whoever recorded or owns the footage — your club, the league, or a broadcaster
• Every identifiable person appearing in the content — teammates, opponents, coaches, spectators — has consented to it being uploaded and shown on a profile that may be public

You will indemnify us and hold us harmless against third-party claims, damages, and reasonable legal costs arising from your content or from a breach of these warranties.

If a third party raises a claim about your content, we may remove or hide that content while we look into it. Where reasonable, we will tell you that we did.

Your profile is private by default. It only becomes public after you give your explicit consent to publication. You can unpublish your profile at any time.

7. Verified Information

Some profile metrics and stats may carry a "verified" badge. This means our team reviewed supporting evidence for the data. Verification is a plausibility check, not a guarantee. We do not warrant that verified data is correct.

8. No Recruiting Outcome

The Service is a presentation tool. It gives you a place to keep your profile, your stats, and your film, and a link you can send to whoever you want. That is what it does.

We do not promise or guarantee any recruiting outcome. That includes contact from scouts or coaches, invitations to try-outs, offers, admission to a school or program, and scholarships. No communication on the platform — from us or from anyone else — constitutes such a promise.

Coach endorsements shown on a profile are the opinion of the coach who wrote them. They are not our assessment and not a promise by us.

9. Terms for Coaches

If you use the Service as a coach, the following also applies to you:

• The credentials you give us — your name, club, role, and any license documents — must be truthful and current
• Write endorsements in good faith, based on genuine, first-hand experience with the athlete. Do not endorse an athlete you have not worked with
• You are responsible for the content of your review. It is your opinion, published under your name
• Private notes and watch lists you keep on the platform are stored on our systems. They are not anonymous: we may have to disclose them where the law requires it, including in response to a data-access request by the athlete concerned
• Do not scrape profile data or collect it in bulk. The Service is for looking at individual athletes, not for building a database

10. Prohibited Conduct

You agree not to:

• Provide false or misleading information on your profile
• Misrepresent your athletic data, stats, or achievements
• Impersonate another person or athlete
• Upload content you do not have the rights to use
• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Scrape, collect, or harvest user data without authorization
• Use the Service to spam or harass other users

11. Reporting and Takedown

Anyone can report a profile using the report link on that profile. We review reports. If content or behavior violates these Terms, we may remove the content or suspend the account.

12. Intellectual Property

The Service itself — its design, features, and original content (excluding user content) — belongs to us and is protected by copyright, trademark, and other intellectual property laws.

13. Termination

You can stop using the Service and delete your account at any time from your profile (or by contacting us, if you cannot sign in). We may suspend or terminate your account if you violate these Terms or harm other users, us, or third parties. Where reasonable, we will tell you why.

14. Disclaimers

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the accuracy of information provided by users, including verified data (see section 7).

15. Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential damage arising from your use of the Service. This includes lost opportunities, missed recruiting or sporting chances, lost profit, and reputational harm.

Because the Service is free of charge, our total liability to you for all claims taken together is limited to CHF 100 [amount to be confirmed by counsel].

Keep your own copies of the videos and files you upload. The Service is not a backup or archiving service. We do not warrant that uploaded content will be preserved, and we are not liable for its loss, corruption, or deletion.

The Service is provided "as is" and "as available" (see section 14). We give no guarantee of availability or uptime, and we may change, suspend, or discontinue features.

We are not liable for failures caused by events outside our reasonable control, including outages at our hosting or storage providers, network failures, cyber-attacks, strikes, natural events, and acts of authorities.

None of the above excludes or limits liability for damage caused by our intent or gross negligence, or any other liability that cannot be excluded under Swiss law (Art. 100(1) of the Swiss Code of Obligations).

16. Changes to These Terms

We may change these Terms. If a change is material, we will announce it before it takes effect — for example by email or by a notice in the Service. If you keep using the Service after the change takes effect, the new Terms apply to you.

17. Governing Law and Jurisdiction

These Terms are governed by Swiss law. The place of jurisdiction is the registered seat of Athlete World GmbH. Mandatory consumer venues under applicable law remain reserved.

18. Language

These Terms are written in English. If they are translated, the English version prevails.
